The widow of the late Ikemba of Nnewi, Chukwuemeka Odumegwu Ojukwu, Bianca, has opposed an application by her husband’s son, seeking to be joined as a defendant in a suit she filed against the family over property.
Emeka Odumegwu Ojukwu Jr., Ojukwu’s second child, filed the application dated May 24, before Justice Abdulfattah Lawal of the Lagos State High Court, Igbosere, seeking to be joined alongside Ojukwu Transport Limited (OTL) and seven others.
Bianca had on behalf of her two under-aged children, Afamefuna and Nwachukwu (claimants), sued Ojukwu Transport Limited (OTL) and seven others over an alleged threat by the family to eject them from the company’s properties in Lagos.
OTL was established by the late Biafran leader’s father, Sir Louis Ojukwu.
In his application, Ojukwu Jr. prayed the court to join him on the grounds that he is a director in OTL and by virtue of his position has responsibility to look after the interest of the other children of his late father.
He averred that the claimants in the suit are the last two of the eight children of his late father and they are represented by their mother who was the last of the six wives of his late father.
The son of the late Biafran warlord prayed the court to join him as defendant in the “best interest of justice.”
He added that any decision in respect of the claims of Bianca’s two children in the suit so far as it relates to his father’s interest in OTL “will affect me as the current head of the late Dim Chukwuemeka Ojukwu’s family.”
However, in a 12-paragraph counter affidavit, Bianca’s children opposed their elder brother’s application.
They averred that they have no claim or relief whatsoever against him in the suit and that that the suit can be duly and properly determined without their elder brother as a defendant.
The claimant said the application was only a ploy to delay and scuttle the hearing and determination of the suit.
Other defendants in the suit are Prof. Joseph Ojukwu, Emmanuel Ojukwu, Lotanna Putalora Ojukwu, Dr. Patrick Ojukwu, Edward Ojukwu, Lota Akajiora Ojukwu and Mrs. Massey Udegbe (doing business under Massey Udegbe & Company).
In their statement of claim, Bianca, and her two children are praying the court to declare that the alleged threat of forcible ejection from 29, Oyinkan Abayomi Street, Ikoyi, by the defendants as illegal.
They are asking the court for a declaration that her children are entitled to possess the following property: No. 13 Hawksworth Road, Ikoyi (now known as No. 13 Ojora Road; No. 32A Commercial Avenue, Yaba, Lagos; No. 30 Gerard Road, Ikoyi, Lagos and No. 30 McPherson Avenue, Ikoyi.
According to them, the properties were under the possession of the late Chukwuemeka Odimegwu Ojukwu, the father of the claimants, from the time the properties were released from government acquisition till date.
The claimants stated that throughout the period their father was fought to retrieve the properties from the government, the second to seventh defendants “never played any role in the struggle nor contributed financially or otherwise to the realisation of the struggle.”
Justice Lawal will hear the argument for the application on September 14.

Further hearing in a suit filed by Bianca Ojukwu, widow of the late Ikemba of Nnewi, Chukwuemeka Odimegwu Ojukwu, against Ojukwu Transport Limited (OTL) and seven others was stalled yesterday. At the resumed hearing of the suit yesterday before a Lagos High Court, Bianca’s lawyer, Nick Omeje, prayed the court for an adjournment to enable him amend the claimant’s originating summons.

Consequently, Justice Abdulfattah Lawal adjourned the matter till February 29 for the hearing of the motion and April 26 and 27 for continuation of trial. It will be recalled that on Monday she told the court she was the sole legally married wife of her late husband having done court, church and traditional marriage, unlike the other wives that only did traditional marriages. Bianca, suing for her two underaged children, Afamefuna and Nwachukwu (claimants), wants the court to declare that her children are entitled to the possession and occupation of the property known as No 29, Oyinkan Abayomi Street, Ikoyi, Lagos, until the harmonisation of the management and administration of the assets of the first defendant, OTL. In their statement of claim, the claimants want the court to declare that the threat of forceful ejection from 29, Oyinkan Abayomi Street by the defendants is illegal. In addition, they urged the court to declare that they are entitled to possess the following properties, No 13 Hawksworth Road, Ikoyi percent(now known as No. 13 Ojora road); No 32A Commercial Avenue, Yaba, Lagos; No 30 Gerard Road, Ikoyi, Lagos; No. 30 McPherson Avenue, Ikoyi.

All the above properties were alleged to be under the possession of late Ojukwu, father of the claimants, from when the properties were released from government acquisition till date. The claimant is asking for an order of court restraining the defendants, their agents or privies from interfering with the claimants’ possession and control of the properties. But, in their statement of defence, the 1st -7th defendants averred that the subscribers of the memorandum of association of Ojukwu Transport Limited (1st defendant) at incorporation in 1952 were L.P. Ojukwu and Betram Chukwuemeka Obi, adding that the late Odimegwu Ojukwu and one Professor Joseph Ojukwu (2nd defendant) were later appointed as directors in 1953.

They stated that late Odimegwu Ojukwu thereafter ceased to be a director of the company prior to the Nigerian civil war and was reappointed as a director on December 16, 2005 while the 3rd and 4th defendants were appointed directors in 1954 and 2005 respectively. They added that the claimants’ statement of claim contained tissues of lies and distorted facts, alleging that Bianca who instituted the suit, ‘‘being greedy felt she could hold unto the company’s properties.’’ Besides, they stated that for over 12 years prior to his death, Dim Ojukwu moved to Enugu State and since then had not lived at any of the company’s properties as alleged by the claimant.

The ongoing legal battle between the widow of the late Ikemba of Nnewi, Chukwuemeka Odimegwu Ojukwu, Bianca Ojukwu and his brothers over the family estate was yesterday stalled due to her absence in court.

Mrs. Ojukwu had on behalf of her two under-aged children, Afamefuna and Nwachukwu (claimants) dragged Ojukwu Transport Limited (OTL) and seven others before a Lagos State High Court sitting in Igbosere over an alleged move by the family to eject her sons from their late father’s properties located in Lagos.

She had asked the court to declare that her children are entitled to the possession and occupation of one of the properties known as No 29 Oyinkan Abayomi Street, Ikoyi Lagos until the harmonisation of the management and administration of the assets of the first defendant (OTL).

The defendants in the suit are; Prof Joseph Ojukwu, Engr. Emmanuel Ojukwu, Lotanna Putalora Ojukwu, Dr Patrick Ojukwu, Arc Edward Ojukwu, Lota Akajiora Ojukwu and Mrs Massey Udegbe (doing business under Massey Udegbe & Company).

At the resumed hearing of the matter yesterday, counsel to the defendants Chief George Uwechue (SAN) informed the court of a letter signed by Bianca’s lawyer, Chioma Okoro stating that Bianca won’t be in court because of a meeting with the United Nation’s World Tourism Organisation Secretary General, Dr. Taleb Rafai scheduled for November 9, 2015.

The letter dated October 23 reads in part ‘’the claimants witness, Mrs Bianca Odumegwu Ojukwu, who is the Nigerian Ambassador to Spain, is meeting with UN World Tourism Organisation Secretary General, Dr. Taleb Rafai on 9th November, 2015 in Spain. Kindly find attached a copy of the UNWTO’S letter on the proposed meeting’’.

The trial judge, Justice Abdulfattah Lawal said that though the court did not receive a copy of the letter he would give the claimant the benefit of the doubt and adjourned the suit still December 11 for trial.

In the suit, Bianca, and her two children, had in their statement of claim, prayed the court to declare that the threat of forceful ejection from 29 Oyinkan Abayomi Street by the defendants is illegal.

She is also asking the court for a declaration that her children are entitled to possess the following property, namely: No 13 Hawksworth Road, Ikoyi (now known as No. 13 Ojora road); No 32A Commercial Avenue, Yaba, Lagos; No 30 Gerard Road, Ikoyi, Lagos; No. 30 McPherson Avenue, Ikoyi.
