Amid high rate of foreclosures, loan defaults and stressed assets in the financial market, an Abuja-based independent real estate consultant is establishing a first-of-its-kind property auction in Nigeria to sell distressed and non-distressed assets at almost half the price of their value.

The auction market offers a chance to buy property at a low price. Reportedly, auctions are the proven and popular way of buying and selling properties in many countries such as Australia, New Zealand, UK and the US owing to their speed, certainty and simplicity.

Under the platform, Real Estate Auction Network has unveiled plans to dispose three prime property valued at N8.9 billion at half the price. The property all located in Abuja include, Royal Tropicana Hotel valued N5.5 billion, auction price N2.5 billion; and Mall valued N2.5 billion, auction price N750 million and Filling Station with shopping mall valued N850 million, auction price N350 million.

Chairman of the Auction Network, Felix Osuji, described the offer as an outstanding opportunity to own properties in the Federal Capital Territory, “Auctions like this are great opportunities for owner occupants and investors to name their price on properties with great upside potential.

“Auctions continue to be the number one asset disposition strategy for banks, corporate bodies and individuals all over the world. With registration for the auction already commenced.”

According to him, interested bidders and buyers in the auction scheduled for August 20, could view the properties by attending one of the on-site inspections scheduled from July 30 to August 6 and 13, 2016.

One of the banks involved in the auction process and a Regional Manager, Abubakar Mohammed, said: “We are using the auction to dispose these properties. This would not only provide buyers with a quick sale but also assure them of that the properties will close.”

Real Estate Auction Network is an asset acquisition and disposal organisation that have worked on auctions with banks, brokers and agents, real estate developers, individuals, REITS, Fortune 500 corporations and others.

Operatives of the X-Squad of the Federal Investigation Department, FCID, Alagbon Close, Ikoyi, Lagos, western Nigeria, have arrested an 85-year-old man, Emmanuel Olatoye Shodipe, who claimed be a Reverend Father, and two others, for allegedly conspiring with others at large to forge a Power of Attorney as the trustees of the estate of Madam Iyalode Tinubu at Mushin area of Lagos, Western Nigeria.
Other suspects arrested in connection with the alleged crime include Tajudeen Olalekan Ademoye Tinubu, 55, and Omotayo Oyindamola, 54.
After investigation, the suspects were arraigned before an Igbosere Magistrates’ court, Lagos Island, on a four-count charge of felony to wit, forgery, giving false information to the police against Akindele Afolabi and Alhaji Adio Kazeem.
Police prosecutor, ASP Henry Obiazi, informed the court in charge No C/14/2016 that the accused persons committed the alleged offence in August, 2014 at Mushin, Lagos.
Obiazi told the Court presided over by Magistrate Mr B. A. Shonuga that the accused persons forged a Power of Attorney of the estate of Madam Iyalode Tinubu with intent to deceive and defraud members of the public that they are the trustees of the estate, a claim Obiazi said the accused persons knew to be false.
Obiazi further told the court that to actualize their plan, the accused persons gave the police at the Zone 2 Command, Onikan, Lagos a false information against Akindele Afolabi, the original trustee of the estate, and Alhaji Adio Kazeem, knowing full well that they were innocent of the allegations.
Obiazi said the offences the accused persons committed are punishable under sections 409,363(3) 94 and 378(1) of the criminal Laws of Lagos State, 2011.
The accused persons however denied the police allegations in the open court when the charges were read to them.
Their Counsel, Barr. Oluwanisola Oyenekan, N.G. Lawani and D.O. Abe urged the Court to admit the defendants to bail on liberal terms with a promise that they will not jump bail.
Magistrate Shonuga admitted Tajudeen Tinubu and Omotayo Oyindamola to bail in the sum of N200,000 each with one surety each in like sum, and the 85-year-old Shodipe granted bail on self-recognition due to his age.
Shonuga adjourned the case till 12 April for mention.

The suit instituted by The Nigeria Stock Exchange (NSE) against its former Director General Nididi Okereke Onyiuke and others to recover a building alleged to have been acquired illegally has been adjourned till 1st of March, 2016 for either report of settlement or hearing.
Others joined as co-defendants in the ensuing property recovery suit are former assistant director general of the NSE, Lance Musa Elakama, Hybrid Properties Limited, Oak Business and Finance Limited, Minister of Land, Housing and Urban Development, Federal Land Registry.
In a statement of claim filed before a federal high court in Lagos, South west Nigeria, by a Lagos-based lawyer, Chief Bolaji Ayorinde SAN, on behalf Nigerian Stock Exchange NSE, it was alleged that sometime in 2012, the NSE carried out an audit of its landed properties and discovered that it could not locate the original copy of certificate of occupancy of one of his landed property.
It was alleged that Dr Ndidi Okere-onyiuke acting in concert with Lance Musa Elekama, upon a false resolution of the Nigeria Stock Exchange, unlawfully and illegally executed a Deed of Assignment dated 20 May 2007, on Sunday which is non working day by law in favour of Hybrid Properties Limited and Oak Businesses and Finance Company Ltd. by which Nigeria Stock Exchange purportedly transferred its proprietary of the property at 2 Temple Road, Ikoyi to the two companies.
Consequently enquiry was set in motion, upon conducting a search on the 12th of March, 2014 and obtained from the federal Lands Registry, it was discovered that on the 20th of May, 2007 that then Minister of Land, Housing and Urban Development gave his consent to the deed of assignment purportedly executed by NSE in favour of HY Bybrid Properties Ltd and Oak Business and Finance company.
Dr Ndidi Okereke Onyuike and Lance Musa Elekama while being Director-General and Assistant Director General of NSE respectively executed the deed of assignment in favour of the aforementioned companies, nevertheless their identities did not appear on the said Deeds of Assignment.
It was discovered through a search conducted at Corporate Affairs Commission that Lance Musa Elekama was having 600,000 shares out of the 1,000,000 fully issued shares of Oak and Finance company while Ndidi Okereke-Onyuike was holding 800,000.shares in the shares of Hybrid Properties while Lance Elekama held 600,000 shares in the share capital of Hybrid Properties, also as a majority shareholder.
Consequently the NSE execution of the aforementioned Deeds of Assignment was fraudulently done by Ndidi Okereke-Oyeuike and Lance Musa Elekama, irregularly consented to by the then Minister of Lands, Housing and Urban Development and fraudulently registered by Federal Lands Registry with intention of illegally, unlawfully and permanently deprive NSE of its proprietary rights to the property.
It was further alleged that Ndidi Okereke and Lance Elekama who are the majority shareholders of these two companies allegedly paid the sum of N420,750,000 as purchase price of the property to the NSE, the two of them who were conversant with the inner working of NSE and its approval process as it relates to the execution of documents for and on behalf of NSE knew at the time of the execution of the Deed of Assignments that they did not have the authority of NSE as it relates to documents under seal and title transfer documents to execute the said Deeds of Assignment in favour of the two companies as they were aware that the said execution was unlawful,illegal and clear violation of the Article o Association of NSE.
But the two companies, Hybrid Properties Limited, Oak Business and Finance Limited never paid any sums to NSE as consideration for transfer/sale of the NSE’s proprietary interest in the property, neither did Ndidi Okereke-Oyuike and Lance Elekama make any such payment
Consequently, the claim against the defendants jointly and severally are as follows:
A declaration that Dr Ndidi Okereke and Lance Musa Elekama acting alone or together are not empowered to execute for and on behalf of NSE any instrument of transfer of title to landed property.
An order of the court setting aside or striking down the Deed Assignment dated 20th May 2007 purportedly executed by the NSE in favour of the two companies relating to the NSE proprietary interest in 2 Temple Road, Ikoyi Lagos.
An order of the court directing the defendants to pay to the plaintiffs the sum of N36 million as solicitors fee.

THE Onikoyi Family, Lagos has instituted a suit against the Federal Government before a Federal High Court sitting in Ikoyi, Lagos asking the court for an order directing the  government to include them in future transfer of land and meeting pertaining to the return of properties to the Onikoyi Royal Family.

The plaintiffs are also asking the court for an injunction restraining Oba Patrick Ibikunle Fafunwa, the Onikoyi of Ikoyi/Moba land from usurping the alleged rights of the 10 branches of Onikoyi Family including the sale of land and usage as his personal property.

Sued along Oba Fafunwa are: the Attorney-General of the Federation, the Minister of Lands, Housing and Urban Development, the Implementation Committee of the White Paper on the Commission of Enquiry into the Alienation of Federal Government Property and Unknown Persons.

In the motion filed they urged the court for an order partitioning the 4.324 hectares of land which is the subject matter of suit No: LD/769/12 into 10 portions for the 10 branches that make up the Onikoyi Royal Family.  The plaintiffs include: Fatai Ogunlana Onikoyi, Chief Muritala Adedoyin Elegushi, Alhaji Waliu Dimeji Sulaiman, Onikoyi Animashaun Abdulfatai Kolawole and Mufutau Onikoyi.

Oyebode Shadeko, Halim Akinyemi Eshinlokun, Adja Ganiat Onikoyi Carew, Alhaja Taibat Jenmi-Owo and Idris Owoyele.  Other are: Alhaji Bilikis Bombata, Lookman Adeshina, Alhaji Tinko Aderemi, Ganiyu Onikoyi, Bolanle Doherty, Alhaja Suliat Shodiya and Fatai Onikoyi Shina for themselves and on behalf of Fafunwa, Ojubiari, Kunayije, Ilumo and Idewu Kugbamola.

The General Manager, Lagos State Public Works Corporation, Mr. Ayotunde Sodehinde, says the state government plans to rehabilitate more roads in the state.

Sodehinde, who stated this during a tour of the ongoing Ikotun-Ejigbo Road project, said the state government had recently awarded the rehabilitation of a bad portion of Regina Mondi, in Mushin Oloosa, and had also directed that palliative and rehabilitation work should commence on Fadeyi Road; Brown Street, Oshodi; Naval dockyard, Apapa and Ketu outward to Ikorodu.

He said the ongoing drainage work on the Ikotun-Ejigbo Road would assist in containing rain water and discharge from homes and industries to the bigger drains.

According to him, other roads in need of rehabilitation within the state will also be attended to in due course.

He added that in the last three months, the LSPWC had carried out palliative and minor rehabilitation work on about 120 roads in the state and that 33 teams of the corporation were at various locations of the state monitoring the roads, to identify all the bad portions needing attention.

“The bad weather and paucity of funds contribute immensely to the slow pace of road repairs in the state but as soon as the rains subside, all the roads will be attended to,” he said.

Sodehinde said the Lagos State Governor, Mr. Akinwunmi Ambode, had directed that all the 57 local government councils should submit at least four bad roads in their neighborhood to the state government for rehabilitation and reconstruction.

He said, “Amongst the roads the corporation has worked on in the last three months are the Lekki-Epe Expressway; Eleran Igbe T-Junction, Epe; Odunlani Street, Bariga; Adekoya Street, off College Road, Ifako Ijaiye; Fatai Atere Way, Ladipo; Lakowe-Bogige inward Ajah; and Town Planning Way/Industrial Avenue, Ilupeju.

“We have also worked on Lawanson-Itire Road, Ijesha, Surulere; MKO Gardens Road Alausa; Alhaji Akinwunmi Street, Ladipo, Mushin; Asa Afariogun Street and Lateef Salami Street, both in Ajao Estate, to mention just a few.”

Sodehinde however said that the automobile mechanics using the roads as their garages to repair vehicles should desist from the act as chemical discharge such as oil, petrol and diesel could damage the roads.

He also urged car-wash operators to ensure that they channel their waste water properly as it is unfriendly to asphalt used for road construction.
